Vrtual.ly (“Vrtual.ly,” “we,” “us,” or “our”) provides a software platform and related services that help businesses manage responses to their marketing and other inquiries, including questionnaires, routing, scheduling, communications, reminders, payments where enabled, and reporting (collectively, the “Service”).
This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit our website, use the Service, communicate with us, or interact with a business that uses Vrtual.ly.

Depending on how you interact with Vrtual.ly, we may collect:
- Contact and account information, such as name, email address, telephone number, business name, login credentials, and account settings.

- Transaction and payment-related information when payment features are enabled. Payment processing may be performed by third-party payment providers; Vrtual.ly may receive transaction status and related records rather than full payment-card information.
- Communications information, including messages sent to or from Vrtual.ly and records of consent, opt-in, opt-out, and messaging activity.
- Marketing and attribution information, such as the campaign, source, channel, keyword, page, or other information associated with an inquiry or response.
- Technical and usage information, such as IP address, browser type, device information, pages viewed, dates and times of access, referring pages, and Service activity.
- Cookies and similar technologies used to operate, secure, understand, and improve the Service.
2. Information We Process for Our Business Customers
Businesses use Vrtual.ly to collect and manage information from their prospects, customers, clients, and other contacts. When we process personal information on behalf of a business customer, that business generally determines why and how the information is collected and used. Vrtual.ly processes that information to provide the Service and according to the customer’s instructions, our agreements, and applicable law. Questions about a business customer’s own privacy practices should be directed to that business.
3. How We Use Information

- Create and administer accounts and provide customer support.
- Process requests, questionnaires, routing, scheduling, confirmations, reminders, communications, and other Service workflows.
- Process transactions and maintain related business records when payment functionality is used.

- Comply with legal obligations and protect the rights, safety, and property of Vrtual.ly, our customers, users, and others.
4. Mobile Information and SMS Consent
Your mobile information will not be sold or shared with third parties for promotional or marketing purposes.
Text messaging originator opt-in data and consent will not be shared with third parties for purposes unrelated to providing the requested messaging service. We may share information with service providers, telecommunications carriers, and other vendors only as necessary to provide and deliver our messaging services.
Where Vrtual.ly offers an SMS program, participation is voluntary. Message frequency may vary and message and data rates may apply. You may reply STOP to opt out of future messages from the applicable program and HELP for help. Consent to receive marketing text messages is not a condition of purchase.
5. How We Share Information
We may disclose personal information in the following circumstances:
- With the business customer on whose behalf we collected or processed the information.
- With service providers and vendors that help us host, operate, secure, support, analyze, communicate through, or otherwise provide the Service.
- With telecommunications carriers and messaging providers when necessary to send or receive communications.
- With payment processors and other transaction providers when payment functionality is used.
- When required by law, legal process, or a valid governmental request, or when reasonably necessary to protect rights, safety, security, or prevent fraud or abuse.
- In connection with a merger, financing, acquisition, reorganization, sale of assets, or similar corporate transaction, subject to applicable law.
- With your direction or consent.
We do not sell or share mobile information or text messaging opt-in data and consent with third parties for their promotional or marketing purposes.
6. Cookies, Analytics, and Similar Technologies
We may use cookies and similar technologies to keep the Service functioning, remember preferences, understand usage, improve performance, and support security and analytics. We may use third-party analytics providers. Your browser may allow you to block or delete cookies, although some Service features may not function properly if cookies are disabled.
7. Data Retention and Deletion
We retain personal information for as long as reasonably necessary to provide the Service, fulfill the purposes described in this Policy, meet contractual and legal obligations, resolve disputes, enforce agreements, and maintain appropriate business records. Retention periods may vary based on the type of information and the context in which it was collected.
You may request deletion of personal information that Vrtual.ly controls by contacting care@vrtual.ly. We may verify your identity before processing a request. We may retain information when required or permitted by law, for legitimate business purposes, or in backups until those backups are overwritten in the ordinary course. Information that has been de-identified or aggregated may not be capable of being associated with an individual.
If your information was collected through a business that uses Vrtual.ly, you may need to direct your request to that business because it may control the information.
8. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No method of transmission or electronic storage is completely secure, and we cannot guarantee absolute security.
9. International Data Transfers
Vrtual.ly and its service providers may process information in the United States and other locations. Where required, we take steps intended to provide appropriate protections for personal information transferred across jurisdictions.
10. Third-Party Services and Links
The Service may integrate with or link to third-party websites, applications, communications providers, payment providers, video-meeting providers, and other services. Their privacy practices are governed by their own policies, and Vrtual.ly is not responsible for third-party privacy practices.
11. Children’s Privacy
The Service is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13. If we learn that we have collected such information without appropriate authorization, we will take reasonable steps to delete it.
